Current measures in the Property Owners' Associations of Catalonia
Therefore, if you live in a Community of Owners within Catalonia, you should know that due to the current situation caused by COVID-19, the obligation to call and hold meetings in the Communities of Owners is still suspended.
In principle, as indicated in Decree Law 53/2020 of December 22, which extends and modifies Decree Law 10/2020 of March 27, this will have to be the case until December 31, 2021.
Even so, and for this same reason, the budgets and positions of the Board are also extended until the same date, and as of December 31, 2021, when the Ordinary Meeting can be held, the accounts will be approved and the positions will be renewed.
How can I call a meeting in my community?
If your Community needs to call a Meeting of Owners to resolve or approve some important issues, the suspension of the obligation to call community meetings does not exclude the Community from holding meetings at the initiative of the President or at the request of at least 20% of the owners with the right to vote and who represent a coefficient of at least 20%.
To be more precise, the special regulations regarding this issue establish that the Owners' Meetings can currently be held in the following three ways:
In person
As long as the health measures are respected, and a maximum of 6 people is not exceeded.
Telematically
Through the means established in article 312.5.2 of the Civil Code of Catalonia and guaranteeing the identification of attendees, the continuity of communication, the possibility of intervention and the casting of votes.
Agreements without meeting
Until the Ordinary Meeting is convened and held, at the request of the President of the Community, “agreements without a meeting” may be made. Voting must be done by post or electronically, guaranteeing the rights to information and voting so that the receipt of votes is recorded. It is essential to set the deadline for the issuance and receipt of votes, which must be at least 8 days.
