1. New classification of deficiencies
The decree expands the classification of deficiencies into four categories, providing a more detailed analysis:
- Very serious: Imminent and widespread risk to the stability of the building and the safety of people. Requires immediate intervention.
- Graves: Significant risk to specific elements or severe health problems. Urgent precautionary measures required.
- Important: They do not represent an immediate risk, but they affect the functionality and health of the building, requiring corrective intervention.
- Mild: They need preventive maintenance to avoid future problems.
2. Mandatory incorporation of recommendations
The new decree requires that ITEs include:
- Technical recommendations to improve sustainability and energy efficiency.
- Deadlines for carrying out corrective and maintenance actions.
- Evaluations of universal accessibility of the property.
3. Deadlines for carrying out the ITE
The established deadlines vary according to the age and type of building:
- Multi-family buildings:
- Built before 1951: Should have already passed inspection.
- Between 1951 and 1960: Until December 31, 2015.
- Between 1961 and 1971: Until December 31, 2016.
- After 1971: In the year in which they reach 45 years of seniority.
- Single-family buildings:
- Built before 1900: Until December 31, 2016.
- Between 1901 and 1930: Until December 31, 2017.
- Between 1931 and 1950: Until December 31, 2018.
- After 1975: In the year in which they reach 45 years of seniority.
Note: Single-family buildings separated by at least 1.5 meters from the public road or with a valid habitability certificate are exempt until it expires.
4. Validity of the certificate of fitness
The certificate has different validity periods depending on the level of deficiencies detected:
- 10 years: If the building has no deficiencies or only minor ones.
- 6 years: For major deficiencies, with periodic reviews.
- 3 years: For serious or very serious deficiencies, with annual reviews.
5. Rehabilitation program
After obtaining the certificate of fitness, owners must pass a rehabilitation program supervised by a qualified technician, ensuring that the necessary repairs are carried out.
